What Is Drug Court?

Drug Court and Pre-Trial Intervention (PTI) are the two main alternatives to prison in New Jersey at the Superior Court level.

The State and the defense attorney work together to provide assistance to a non-violent drug addicted offender by allowing them into Drug Court. A defendant may be eligible for drug court under N.J.S.A. 2C:35-14 (Special Probation for prison-bound offenders) or N.J.S.A. 2C:45-1 (Ordinary Probation) according to the guidelines of the Drug Court Manual. The Drug Court probationary period requires intensive probation supervision, including frequent and random urine testing, along with employment and other counseling and drug treatment programs. This is not a program that is easy, or indeed even recommended for most drug offenders. This is a program where only a defendant who truly wants to free themselves from addiction can succeed.

This program is also extremely helpful to the State by creating productive members of society while also alleviating some of the drug problems and prison crowding problems in New Jersey.

Drug charges can be handled in either Municipal or Superior court. The more severe the criminal charges the more likely they are to be handled in Superior Court, while minor charges are typically resolved in Municipal Court. We have a well deserved reputation for being the best in both arenas.

The severity of your charges is a determination made by the State and is usually based on the weight of the drugs and a variety of other factors. Penalties will vary based on the degree of the crime and whether or not there was a criminal conspiracy involved.
